These terms apply to your use of gohighflier.com (the "Site"), run by GoHighflier ("we," "us," or "our"), a Shopify design and development studio based in Los Angeles, California. By using the Site, you agree to these terms. If you don't agree, please don't use the Site.
1. Using the Site
You may browse the Site and share links to it. Please don't use it for anything unlawful, try to break or overload it, get into parts of it you aren't meant to reach, or copy large parts of it with automated tools.
2. Our content
The text, design, code and graphics on the Site belong to GoHighflier or are used with permission. You may not copy, republish or sell them without our written permission, except for short quotations with a link back to the Site.
Client names, logos, photography and websites shown in our case studies belong to those clients and appear with their permission. They may not be reused without the client's consent.
3. Information on the Site
Our case studies, Insights articles and service descriptions are general information about our work and about ecommerce. They aren't professional advice for your specific business, and results described for one client aren't a promise of the same results for another. We try to keep the Site accurate and up to date, but we may change or remove content at any time.
4. Working with us
These terms cover the Site only. Any project we take on is governed by a separate written agreement signed by you and us, and that agreement controls if it differs from anything on the Site. Contacting us, or receiving a proposal or estimate, doesn't create a client relationship until that agreement is signed.
Please don't send passwords, payment details or other sensitive information through email or social media. If a project needs access to your store or accounts, we'll arrange it securely once work begins.
5. Other websites and tools
The Site links to other websites, including our clients' stores, our social media profiles, and platforms such as Shopify, Klaviyo and Mailchimp. We don't control those sites and aren't responsible for their content, policies or availability.
6. No warranties
The Site is provided "as is" and "as available." To the extent the law allows, we make no promises that it will always be available, error-free or free of viruses, and we disclaim all warranties, express or implied.
7. Limitation of liability
To the extent the law allows, GoHighflier won't be liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from your use of the Site or your reliance on its content.
8. Your responsibility
If you misuse the Site or break these terms, you agree to cover any claims, losses or costs that result for GoHighflier, including reasonable legal fees.
9. Privacy
How we collect and use information is explained in our Privacy Policy.
10. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute about the Site will be handled in the state or federal courts located in Los Angeles County, California.
11. Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they last changed. Continuing to use the Site after a change means you accept the updated terms.
